While Employer’s have a reprieve of sending out the Federal Notice (see below) letting employees know of any Group Health Plans (get a free quote) or if nothing is offered. The Covered CA application page 24, requires that the Employer give information about any Group Insurance or if nothing is available, so that the employee can complete their application for Covered CA and comply with the mandate to have health insurance.
Employers MUST notify employees that coverage is available through Covered CA (Exchange) starting 10.1.2013. It appears though that this requirement will not be enforced. See below.

The Department of Labor (DOL) has announced that it will not levy penalties on employers covered by the Fair Labor Standards Act who fail to notify their employees of Exchanges by the PPACA’s October 1, 2013 deadline.
